INTRODUCTION

This Privacy Policy ("Privacy Policy") applies to the personal information we collect through the Web application ("Atom Field" or "Web") at [atomfield-domain] and Mobile Applications ("Mobile App" or "App") at respective app stores (hereinafter collectively referred to as the "Platform").

This Privacy Policy describes the types of personal information we collect on the Platform, how we may use that information and with whom we may share it. We also tell you how you can reach us to ask us to update your preferences regarding how we communicate with you or answer any questions you may have about our privacy practices.

When you access the Platform you accept, without limitation or qualification, the Privacy Policy set forth below and any additional terms of use set forth in the Platform. We reserve the right to modify or update this Privacy Policy at any time and changes will become effective immediately upon posting. You are requested to check for updates to the Privacy Policy periodically.

SCOPE OF POLICY

This policy together with our Terms of Use applies to your use of:

  1. Atom Field mobile application software ("Application" or "App") available on our site OR hosted on the Google Play Store or Apple Store ("App Site"), once you have downloaded or streamed a copy of the App onto your mobile telephone or handheld device ("Device").
  2. Any of the services accessible through the App ("Services") those are available on the App Site or other sites of ours ("Services Sites").

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

CONSENT

By affirming your assent to this Privacy Policy, you provide your consent to such collection, use, storage, processing and disclosure as set out in this Privacy Policy and the Terms and Conditions. The information received by the App will not be shared with any third party or third party service providers for the purposes of advertising or marketing. Atom Field will only be using the information for providing Services to you.

By accessing our services, you agree to this privacy policy. This document supersedes any prior communication on this topic and reflects the entire and exclusive policy for this service.

THE BUSINESS AND ITS STAFF

Atom Field is subscribed to by a business ("Business"). Two kinds of person use the Platform:

  1. The account holder and the administrators, managers and other users the Business appoints. These persons register on the Platform and operate it on the Business's behalf.
  2. The field staff ("Staff") whom the Business enrols on the Platform and who use the Mobile App.

The Business decides which Staff are enrolled, when tracking is switched on, what tasks and forms are assigned, and what information is recorded against each Staff record. We process that information on the Business's instruction and for the purpose of providing the Services.

The Business is responsible for informing its Staff that they are being tracked through the Platform, for the lawful basis on which it does so, and for obtaining any consent or authorisation required of it as an employer under applicable law. We do not enrol Staff, and we have no employment relationship with them.

A Staff member who does not wish to be tracked should raise that with the Business. A Staff member may also write to us at the address in Contact Us, and we will direct the request to the Business that holds the account.

INFORMATION WE OBTAIN

We obtain the following forms of information from you:

Information You Submit

You may choose to provide us with personal information through the Platform, like:

a. Contact information, such as your name, address, telephone number and email address.

b. Payment information, such as your payment card details.

c. Information obtained from the account you use to login to the Platform.

d. Business information submitted at sign-up, such as business name, sector and sub-sector, state and city, employee count band, business email, alternate contact number and name, and the role of the signatory in the organisation.

e. Staff records created by the Business, such as staff name, staff identifier, staff telephone number, reporting manager, and any custom fields the Business chooses to add.

f. Personal information in communications and other content you submit or share, such as photographs and video clips.

g. Information about services received/rendered on the Platform, such as tasks, form responses, customer records, order records and payments recorded against orders.

Location Information

Location is the core of the Services. If you are a Staff member enrolled on the Platform by a Business, we collect the following:

a. The precise and approximate geographic location of your Device, collected at intervals while tracking is active, and used to render the live tracking map and the day's timeline to the Business.

b. Derived movement information, such as distance travelled, time in motion, time at rest, stops and the sequence of places visited during the tracked period.

c. The location at which an attendance event, a task action, a form response, a customer record or an order is recorded.

d. Where the Business has configured a geofence, whether the Device was inside or outside the permitted radius at the time of the action.

e. Signals about the state of tracking on the Device, such as battery percentage, whether location services are enabled, whether location permission has been granted, whether airplane mode is on, whether the tracking service has been stopped, and whether the reported location appears to be mocked. These are collected so that the Business can be told why tracking stopped, and they are shown to the Business as tracking outages.

When location is collected. Location is collected during the working period the Business has configured and while tracking is active on the Device. It is not collected when tracking is off.

Background collection. On mobile devices, location is collected in the background, which means it continues while the App is not open on screen. The App requires background location permission for this. Your Device operating system will ask you for that permission separately, and it can be withdrawn at any time through your Device settings. If it is withdrawn, tracking stops and the Business is shown an outage against your record.

What the Business sees. The Business, and the users it has granted the relevant permissions to, can see live location, the timeline for a selected day, and the reports built on them.

Information We Collect By Automated Means

If you use the Platform, we may collect the following information by automated means:

a. The type of device you use and its operating system.

b. Identification details of your device (e.g., unique device identifier): When you install the App, we store the information we collect with unique identifiers tied to the device you are using. We collect information from the device when you download and install the App and explicitly seek permissions from You to get the required information from the device. The information we collect from your device includes the hardware model, build model, RAM, storage; unique device identifiers like IMEI, serial number, SSAID; SIM information that includes network operator, roaming state, MNC and MCC codes, WIFI information that includes MAC address and mobile network information to uniquely identify the devices and ensure that no unauthorized device acts on your behalf to prevent frauds.

c. Internet protocol ("IP") address.

d. Information about your use of the Platform.

e. Location, as set out above.

f. We don't collect, read or store your personal SMS from your inbox.

g. Camera. We require the camera permission so that you can capture photographs against a task, a form response or a customer record where the Business has configured a field that asks for one, and upload the same on the App.

h. Storage. We require storage permission so that attachments you capture or select can be saved and uploaded from your device, and so that files the Business makes available to you can be downloaded.

Link to Third Party SDK

The Platform uses third party software development kits to deliver parts of the Services. In particular, location collection on the Mobile App is delivered using a third party location tracking SDK, and location data is processed by that provider on our behalf for that purpose. Such providers are bound to use the information only for providing the service to us. We may change or add providers from time to time.

De-Identified and Non-Personally Identifiable Information

We automatically track certain information about you based upon your behaviour on our Platform. We use this information to do internal research on our users' demographics, interests, and behaviour to better understand, protect and serve our users and improve our services. This information is compiled and analysed on an aggregated basis. We also collect your Internet Protocol (IP) address and the URL used by you to connect your computer to the internet, etc. This information may include the URL that you just came from (whether this URL is on our Website or not), which URL you next go to (whether this URL is on our Website or not), your computer browser information, and your IP address. Cookies are small data files that a Website stores on Your computer. We will use cookies on our Website similar to other software-as-a-service websites / apps. Use of this information helps Us identify You in order to make our Website more user friendly. Most browsers will permit You to decline cookies but if You choose to do this it might affect service on some parts of Our Website. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law. Platform Visitor ship Information

We gather information from the Website activity, such as data on the number of people who visit the Platform, the pages they visit, the duration of their stay, etc. Platform Visitor ship Information includes:

a. Collected on an aggregate, anonymous basis, which means no personal identifiable information is associated with this data.

b. Gathered through the use of web server logs and cookies.

USES MADE OF THE COLLECTED INFORMATION

We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined.

We store the information collected from the Platform, which is used mainly to enhance the end user experience. The information is processed and analyzed by automated means to offer a variety of features that you get from using the Platform. The information will be used for advanced analytics to offer additional insightful features in future. We may also anonymize (de-personalize) your information we collect and combine it with other information sources for the purpose of advanced analytics and future use cases.

Information collected by us shall be used to:

  1. Provide the Services to the Business, including live tracking, timelines, attendance, tasks, forms, customer records, order records and the reports built on them.
  2. Establish and maintain your account, verify your telephone number through a one time password, and authenticate you when you log in.
  3. Tell the Business why tracking has stopped on a Device, and help the Business and the Staff member restore it.
  4. Provide effective Services to the customer and assist in the event he/she needs additional support.
  5. Administer the subscription, including the staff count the account is activated for, renewals and billing.
  6. Comply with our legal or statutory obligations.
  7. Analyze the app performance, create and serve best products.
  8. Send communications and notifications regarding the products, offerings and the Services.

We do not disclose information about identifiable individuals to other parties, but we may provide them with anonymous aggregate information about our users.

STORAGE AND MAINTENANCE OF INFORMATION COLLECTED

Although we may store or track information about you, however, we shall not be obligated to do so and may delete any information and records, in whole or in part, solely at our discretion.

Where a subscription lapses or is cancelled, the account is locked and the information held against it is retained and is not visible on the Platform until the subscription is renewed.

DISCLOSURE OF INFORMATION

Our customer's privacy is extremely important to us. However, we may disclose certain information obtained due to the following:

a. To our employees, in order to diagnose and resolve any problems or to provide support to you.

b. To any other person, who perform services on our behalf, including billing, survey administration, technical or customer support, location tracking, and provision of email and data analytics.

c. To the business partners, who can alert you about the new services. Upon receipt of any alert if you desire to be removed from such alert list, you may inform the sender or unsubscribe from the list as provided in each mail alert.

d. If we are required to do so by law, regulation or legal process, such as a court order or in response to legal requests by government agencies or when we believe disclosure is necessary or appropriate to prevent physical, financial or other harm, injury or loss or in connection with an investigation of suspected or actual unlawful activity.

e. To the Business that holds the account under which you are enrolled, which is the purpose for which the information is collected.

f. Data can be used for third party integration in order to provide additional services.

USE OF COOKIES

Some pages on the Platform use "cookies," which are small files that the Platform places on your hard drive for identification purposes. These files are used for Platform registration and customization the next time you visit us. Your web browser may allow you to be notified when you are receiving a cookie, giving you the choice to accept it or not. By not accepting cookies, some pages may not fully function, and you may not be able to access certain information on this Website.

SECURITY OF DATA

We and our partners maintain commercially reasonably measures to maintain information security and prevent it from unauthorized access. However, no security is fool-proof and in case we become aware of any breach of security of your information, we will notify you using the mobile number that we have. If you do not agree to the terms discussed above, you should exit our Platform or stop using the same. When you access our Platform, you acknowledge that you have read and agreed to abide by the terms described above.

Our Platform may contain links to third party websites/apps, which are not under our control. We have no responsibility or liability for and we make no representations whatsoever about any other website that you may have access to through our Platform. The inclusion of such links does not imply that we endorse or accept any responsibility for the content or uses of such websites.

FORCE MAJEURE

Notwithstanding anything contained in this Privacy Policy or elsewhere, we shall not be held responsible for any loss, damage or misuse of your user information, if such loss, damage or misuse is attributable to a Force Majeure Event. "Force Majeure Event" shall mean any event that is beyond our reasonable control and shall include without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, network errors, computer hacking, technical snags, unauthorized access to computer data and storage device, breach of security and encryption and any other like event beyond our control.

Where the information is held against a Business account, we will direct the request to that Business, which decides what is recorded and retained on the Platform.

We reserve the right to update, modify and amend any of the terms of our Privacy Policy, at any time without prior intimation to you.
